Notice of Intent to Vacate

We, the undersigned, hereby serve notice that we intend to vacate the above mentioned apartment on the 1st day of September, 2005.
- I am responsible for any and all costs incurred by any other party due to my failure to vacate the premises on or before the date indicated above.
- I may not rescind this notice nor may I change the date of vacating except by written consent of the property owner/manager.
- I am responsible for the full last month’s rent. My Security Deposit may NOT be applied toward payment of any rent due.* Rent will be paid in full on August 01, 2005 for last month of rent.
- My failure to return all key’s (apartment, mail box, laundry room, storage, etc.) issued for my apartment will result in a $25 to $50 charge for each key. I also understand that the apartment will not be considered vacated and I will be responsible for rent until ALL key’s are returned.
COMMENTS:
Stanley Steamer will be coming to clean the carpets on August 27, 2005. A cleaning woman will be coming on August 28, 2005. Apartment will be empty and free for viewing of prospective new tenants beginning on August 29, 2005.
*Under Massachusetts General Law, Ch. 186, § 15B(2), (3), we as tenants have been entitled to demand our full security payment in full, effective one month after moving into 55 Atlantic Street, Lynn, Massachusetts due to landlord’s failure to provide us with a written statement of the name of the bank, location of the bank and account number where our security deposit has been held.
In further violation of Massachusetts General Law, Ch. 186, § 15B(2), (3), landlord has failed to provide tenants with mandatory 5% interest earned on security deposit per year on retained security deposit nor has landlord deducted this accrued yearly interest from any month of rent since our occupation of unit on July 01, 2000.
Additionally, according to Massachusetts General
Law, 186, § 15B(2), (3) landlord’s failure to do so causes a loss of any right to sue for damages to the apartment. (Of which there are none.) Therefore, we are hereby exercising our right under Massachusetts General Law, Ch. 186, § 15B(2), (3) and we therefore demand return of our security deposit in full, plus 5% yearly interest earned on said security deposit, beginning August 01, 2000 and ending upon exit of the premises on September 01, 2005. Failure to return deposit as demanded herewith could result in court action wherein landlord may be subject to a penalty of three times the damage incurred.

Nasty? Yes. But…she reaps what she’s sown.
In other news: Thanks you guys! For all your notes in today’s earlier entry. I feel a little better. Although I still feel bad. I heard back from Michelle regarding Sheila. Michelle did not get bitten although she did get whipped by Sheila’s tail. Michelle said as soon as she put Sheila back in her cage surrounded by all the things she’s familiar with she calmed right down. Sheila was also moving all around her cage last night AND she ate. So those are all good signs that we didn’t stress her too much by moving. Whew.
After work, Big Gay OCD Ted and I are going to hit the beach for a little wading. It’s so humid out today it’s ridiculous.
I’m very happy today. Very happy.

Wow, such a professional notice to vacate! I love it! Do other states have that 5% interest thing? I wonder if Washington has it, and if it does, I wish I knew about it! I wonder how many landlords are getting away with all that extra money?!!
